Mr and Mrs Howd intend to get their money back by taking the previous owners, Bobby and Nicola Console-Verma, to High Court for allegedly misrepresenting the truth about the property.
However Mr Console-Verma claims the Howds are "overly precious" and that after 14 years living on the river bank, inundation of the garden was "a rarity" and he did not consider "the occasional high tide" amounted to "flooding".
A neighbour who has lived in the area nice 1946 says he had adapted to the floods and put it down to tidal changes.
"I have lived here since 1946 and sometimes the house is surrounded by water," he said. The high court hearing is expected to end this week.
